1. About the service
MenuPost is a SaaS platform that provides social-media marketing automation for restaurants. With it you can generate post captions and images with AI, schedule and one-tap publish to social platforms, manage media, plan marketing campaigns, and (depending on your plan) use "Marketing Brain" for attribution, data-driven post suggestions and reports, "seasonal triggers" for timely content, review insights and peer benchmarks, and — with Google Business Profile authorisation — help manage review replies. Some performance features that rely on external data may show sample data or be unavailable until the relevant platform approves access or the data is in place.
2. Account and your responsibilities
- You must provide accurate account details and are responsible for your account security
- You must have the legal right to use the social accounts and business profiles you connect
- You must not use the service to publish unlawful, fraudulent or rights-infringing content
- You must not attempt to bypass plan limits or access other users' data without authorisation
- You can permanently delete your account and all data yourself on the "Restaurant settings" page at any time; deletion cannot be undone and also ends any active subscription billing
3. Pricing and subscription
- During the Sydney pilot, the service is free and no card is required
- When paid plans launch, subscriptions will be offered monthly or annually, billed in AUD via our third-party payment processor
- Paid subscriptions auto-renew: each period's fee is charged automatically on the renewal date until you cancel
- You can cancel at any time in the app; after cancelling you are not charged again and can keep using the plan until the end of the current period
- If a payment fails, you can keep using the paid plan until the end of the current period; if payment is still not completed after that, the account is downgraded to the Free plan
4. Refunds and your Australian Consumer Law rights
Our services come with guarantees that cannot be excluded under the Australian Consumer Law (ACL). Nothing in these terms excludes, restricts or modifies those consumer guarantees or any other right you have that cannot lawfully be excluded.
- During the pilot the service is free, so no fees are charged
- For future paid plans: MenuPost is a digital service billed in advance for each period and made available immediately
- You can cancel at any time to stop future renewals; cancelling stops future charges only, and the current period continues until it ends
- To the extent permitted by law, fees already paid are non-refundable for change of mind — except where a refund or other remedy is required by the Australian Consumer Law or other applicable law (for example, where a consumer guarantee has not been met)
5. AI-generated content
MenuPost uses Google Gemini AI to generate captions and suggestions. Please note:
- AI-generated content (including seasonal suggestions) is for reference only — please review it before publishing
- You are fully responsible for the content you ultimately publish
- MenuPost makes no warranty as to the accuracy or suitability of AI-generated content
6. Performance data and estimates disclaimer
- "Marketing Brain" attribution is a correlation/trend analysis, not proof of causation
- Figures such as customer counts, revenue and ROI are rough estimates based on conservative assumptions, not actual results or guarantees
- Peer benchmarks are anonymised, aggregated references; post suggestions and best-frequency insights are also for reference only
- MenuPost does not guarantee any revenue, customer numbers, reach or marketing outcome; actual results depend on many factors outside our control
7. Availability and third-party dependencies
We strive to provide a stable service but do not guarantee 100% uptime. System maintenance, third-party outages (Meta, Google, our payment processor, Cloudflare, etc.) or policy changes may cause temporary unavailability. Some performance features require Google / Meta approval and real data before they work fully; until then they show sample data or are unavailable.
8. Limitation of liability
To the extent permitted by law, and subject to the consumer guarantees under the Australian Consumer Law (which are not excluded), MenuPost is not liable for any direct or indirect loss arising from your use of the service, including but not limited to: suspension of social accounts, disputes arising from published content, decisions made based on performance suggestions, or third-party API outages.
9. Changes to these terms
We may update these terms at any time. Material changes will be updated on this page and announced on the website or in the app. Continuing to use the service means you accept the updated terms.
10. Governing law
These terms are governed by the laws of New South Wales, Australia, and you and MenuPost submit to the non-exclusive jurisdiction of the courts of New South Wales. Nothing in this clause limits any rights you have under the Australian Consumer Law.
